Why We Ask You to Sign a Representation Form

 before we begin showing you homes or negotiating on your behalf, Florida law requires us to establish — and document — the type of working relationship we'll have together. This isn't just paperwork; it's your legal protection and ours.


The Three Types of Relationships in Florida

Under Florida Statute §475.278, real estate licensees are authorized to work with buyers in one of three ways:

1. 🤝 Transaction Broker (Florida's Default) We provide limited representation to help facilitate the transaction. We assist both sides of the deal but do not owe full fiduciary duties to either party. This is the most common relationship in Florida.

2. ⭐ Single Agent We represent you and only you — with full fiduciary duties including loyalty, confidentiality, and acting solely in your best interest. This requires a written disclosure signed by you.

3. 🚫 No Brokerage Relationship We would simply assist you with no representation at all. This also requires written documentation.


Why the Form Is Required

Florida's FREC Rule 61J2-10.036 is very specific:

  • ✅ The disclosure must use FREC-approved language
  • ✅ It must be delivered before or at the time of showing property or entering an agreement
  • ✅ A signed form is required any time you move from the default (transaction broker) to a higher level of representation

Without this form, we are legally limited in how we can advocate for you.
